Structure of the Business
ByJoyTorres Studio is an independent art studio operated from Ashburton, New Zealand. All transactions, agreements, and disputes are governed by and construed in accordance with the laws of New Zealand.
Intellectual Property & Copyright
Artist Ownership: The artist retains full, exclusive copyright and intellectual property rights to all original artwork, custom commissions, art prints, digital images, and product designs displayed or purchased on this website.
Personal Use Only: Purchasing an original painting, commission, or print grants the buyer ownership of the physical piece only. It does not transfer any reproduction rights.
Prohibitions: You may not replicate, scan, resell, modify, or use any artwork or imagery from this website for commercial purposes, merchandise, print-on-demand services, or advertising without explicit, written contractual consent from the artist.
Custom Commissions & Original Art Contracts
Design & Mediums: Commission timelines, pricing, and specifications (e.g., scale, medium, and subject matter) are agreed upon prior to the start of the project. The creative process takes a flexible estimate of 2 to 4 weeks depending on complexity and material requirements (such as oil paint drying times).
The Approval Process: Upon completion of a custom piece, a final confirmation photograph will be sent to the client via email. The client has exactly 72 hours to review and approve the artwork. If no response is received within this 72-hour window, the artwork will be deemed approved as-is.
Finality: Once an original commission is approved or deemed approved, it will be prepared for shipment. No further changes, alterations, or revisions can be requested or made after this point.
Payment, Pricing & Currencies
Currency: All prices listed on the website are displayed in New Zealand Dollars (NZD) unless stated otherwise.
Price Changes: Prices for our products and services are subject to change without notice.
Payments: All payments for shop orders must be cleared in full before items are packaged and dispatched. For custom commissions, any upfront deposits or payment structures outlined during the booking process are strictly non-refundable, as they secure studio time and materials.
Fulfillment, Shipping & Liability
Dispatched Windows: Ready-to-ship orders are processed within 2 to 4 business days.
Shipping Services: All deliveries are sent via NZ Post Tracked Services. Any delivery windows provided (domestic or international) are strictly estimates supplied by the postal carrier.
Limitation of Liability: ByJoyTorres Studio is not legally or financially liable for unexpected courier delays, postal transit backlogs, weather disruptions, or customs holding delays.
International Customs: International buyers are solely responsible for all local customs duties, import taxes, or VAT fees applied by their destination country. If a package is returned to the studio due to a buyer’s refusal to pay local customs fees or collect the item, the cost of original shipping will not be refunded.
Damaged or Lost Orders
Reporting Window: In the rare event that an order is lost or arrives physically damaged, the buyer must notify the studio at hello@byjoytorres.com within 48 hours of delivery.
Evidence Requirement: To qualify for an official inquiry, compensation claim, or studio remedy, the buyer must provide clear photographic proof of both the damaged items and the outer packaging. We strictly reserve the right to deny claims, refunds, or replacements if photographic evidence is not submitted within this 48-hour window.
Returns & Refunds
Originals & Commissions: Due to the bespoke nature of custom commissions and the unique status of original paintings, all sales of original art and custom commissions are final. No returns, exchanges, or refunds will be issued for change of mind.
Shop Items: Returns or exchanges on standard prints, postcards, or bookmarks are handled on a case-by-case basis. Items must be returned in their original, unused, and undamaged condition at the buyer's expense before a shop credit or refund can be processed. Original shipping costs are non-refundable.
